Market Challenges Create Estate Planning Opportunities

Summary: Although the current economic condition has created financial difficulties for many, it also provides some unique opportunities for managing wealth transfer taxes and maximizing the funds ultimately received by heirs. Charitable Lead Trusts, Grantor Retained Annuity Trusts and Intentionally Defective Grantor Trusts can be especially attractive estate planning strategies in today’s economic climate. This session will focus on the law of endowments, the new accounting rules, and the challenges facing charities in determining their endowment spending rates. We will also review a few “new” ideas for donors reluctant to give to the traditional endowment.

Is It Legal? Is It Ethical? - An interactive discussion of ethical conundrums, loosely organized around the Model Standards of Practice for the Charitable Planners

Summary: One would think that the “rules of engagement” for gift planners would be relatively clear. Not so. There is not always a bright line rule of law to be followed. And, where there is room for interpretation, one organization may be more willing to test the limits than another. Is one right and the other wrong, or is it simply a matter of each organization’s comfort level? Beyond that, just because an action may be within the bounds of the law, or your organization’s interpretation of it, does not necessarily mean that it is an ethical plan of action. In this session we will examine the legal and ethical implications of several real life donor situations. If more questions are raised than answered, all the better.
